Welcome to getFlourish. By accessing or using our website at getflourish.ca or any of our services, you agree to be bound by these Terms of Service in their entirety. If you do not agree with any part of these terms, you must not use our service. These terms apply to all visitors, users, and anyone who accesses or uses getFlourish.
getFlourish provides a digital budget and debt-tracking planner as a subscription-based software service. The platform allows users to track income, expenses, subscriptions, and debt repayment across a 12-month planning period. Features include dual paycheck tracking, a debt snowball calculator, a year overview dashboard, a financial health score, and customizable colour themes. The service is offered on a monthly plan at $7.99 CAD per month, or an annual plan at $71.99 CAD per year, following a 14-day free trial period. All prices are listed and charged in Canadian dollars. getFlourish reserves the right to modify pricing with reasonable notice to existing subscribers.
To use getFlourish, you must create an account through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@getflourish.ca if you become aware of any unauthorized use of your account. getFlourish is not liable for any loss or damage arising from your failure to safeguard your account information. You must be at least 18 years of age to create an account and subscribe to our service.
Your free trial begins on the date you create your account and lasts for 14 days. No credit card is required during the trial period. At the end of your trial, you will be prompted to subscribe to continue using the service. If you choose not to subscribe, your access to the planner will be restricted, but your data will be retained for a reasonable period to allow you to resume your subscription at any time. Subscriptions are billed in advance on a monthly or annual basis depending on your chosen plan. All payments are processed securely by Stripe and are subject to Stripe's own terms of service. By providing your payment information, you authorize getFlourish to charge your chosen payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through your account settings or by contacting us at info@getflourish.ca. Cancellation takes effect at the end of your current billing period, and you will retain full access to the service until that date. All sales are final. getFlourish does not offer refunds for any reason once a payment has been processed. If your payment fails, we will attempt to notify you and may suspend access to your account until payment is successfully processed.
By creating an account or using our service, you consent to receive transactional emails from getFlourish, including account confirmation, welcome messages, trial status notifications, subscription receipts, renewal reminders, and payment failure alerts. These communications are necessary for the operation of the service and cannot be opted out of while your account remains active. In addition, by subscribing to our newsletter through the signup form on our website, you expressly consent to receive periodic marketing emails from getFlourish, including budgeting tips, product updates, and promotional content. This consent is given in accordance with Canada's Anti-Spam Legislation (CASL). You may withdraw your consent to marketing emails at any time by clicking the unsubscribe link in any email or by contacting us at info@getflourish.ca. Withdrawal of consent to marketing emails does not affect your receipt of transactional emails related to your account or subscription.
getFlourish is a budgeting and financial planning tool provided for informational and organizational purposes only. Nothing on our platform constitutes financial, investment, tax, or legal advice. We are not a licensed financial advisor, and the content within the planner should not be relied upon as a substitute for professional financial guidance. Always consult a qualified financial professional before making significant financial decisions. Your use of getFlourish is entirely at your own risk.
To the maximum extent permitted by applicable law, getFlourish and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the service, including but not limited to loss of data, financial loss, or decisions made based on information displayed in the planner. Our total liability to you for any claim arising under these terms shall not exceed the total amount paid by you to getFlourish in the three months preceding the claim.
getFlourish reserves the right to modify, suspend, or discontinue the service at any time with reasonable notice where possible. We also reserve the right to update these Terms of Service periodically. Continued use of the service following any changes constitutes your acceptance of the revised terms. We will make reasonable efforts to notify users of material changes via email or a notice on our website.
These Terms of Service are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of getFlourish shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
